Today’s Issue:

During the COVID-19 public health crisis, are students still entitled to related services under their Individualized Education Program (“IEP”) or Section 504 Plan (“504 Plan”)?

Answer:

Yes. Schools are obligated to implement 504 Plans and IEPs to the “greatest extent possible” and this includes the provision of accommodations and related services, where possible, practical and safe, through remote means. Generally, services such as speech, occupational therapy, physical therapy, ABA therapy and counseling are identified as services which may be provided through remote means.
