Navigating Pennsylvania’s New Hands-Free Driving Law: What You Need to Know
As of June 5, 2025, Pennsylvania has enacted a significant update to its distracted driving laws with the introduction of “Paul Miller’s Law” (Senate Bill 37). This legislation, named in honor of Paul Miller Jr., who tragically lost his life in 2010 due to a distracted driver, aims to reduce accidents and fatalities caused by mobile device use behind the wheel.
What Does the Law Prohibit?
Under Paul Miller’s Law, drivers are prohibited from using handheld mobile devices while operating a motor vehicle. This includes:
- Holding or supporting a device with any part of the body
- Dialing or answering a call by pressing more than one button
- Reaching for a device in a way that requires the driver to move from a seated, seat-belted position
- Engaging in activities such as texting, emailing, browsing the internet, playing games, or using social media
These prohibitions apply even when the vehicle is temporarily stationary due to traffic, a red light, or other momentary delays.
Enforcement Timeline and Penalties
For the first 12 months following the law’s enactment, law enforcement officers will issue written warnings to violators. Starting June 5, 2026, violations will result in a summary offense, carrying a $50 fine plus court costs and other fees. In cases where distracted driving leads to a fatal crash, the driver may face up to an additional five years in prison.
Exceptions to the Law
The law allows for certain exceptions:
- Emergency Situations: Drivers may use their mobile devices to communicate with law enforcement or other emergency services to prevent injury to persons or property.
- Hands-Free Use: Utilizing hands-free technology, such as Bluetooth or voice-activated systems, for making calls, using GPS, or listening to music is permitted. However, even when using hands-free technology, drivers should avoid engaging in activities that require significant attention, such as texting or browsing the internet.
Tips for Complying with the Law
To ensure compliance and enhance safety:
- Use a Phone Mount: Secure your device in a dashboard or windshield mount to keep it within view without holding it.
- Activate Do Not Disturb Mode: Enable features that silence notifications while driving.
- Plan Ahead: Set your GPS destination and adjust music before starting your journey.
- Pull Over Safely: If you need to make a call or send a message, find a safe location to stop and use your device.
The Importance of the Law
Distracted driving is a leading cause of accidents in Pennsylvania. In 2023, there were over 11,000 crashes involving distracted drivers, resulting in numerous injuries and fatalities. By prohibiting handheld device use while driving, Paul Miller’s Law aims to reduce these incidents and promote safer roadways for all.
