Protecting Victims: How Restraining Orders Can Help Combat Revenge Porn
Posted March 7, 2025 | Authors: Katelynn J. Reilly Zachary J. Sireci
In New Jersey, cyber harassment is a form of harassment that involves the use of electronic communication to intentionally harm, annoy, or threaten another individual. One form of cyber harassment is the electronic distribution of explicit photographs and/or videos of another person without their consent or knowledge sent with the purpose to harass. This is more commonly referred to as “revenge porn.”
There has been a significant increase in revenge porn concerns in domestic violence matters. This increase can be attributed to several factors, particularly the rise of digital technology and social media platforms. Social media platforms, such as Snapchat, allow for another layer of fabricated anonymity that allows perpetrators to post and distribute intimate content without being easily identified or held accountable.
However, there are ways to help protect against revenge porn and those who threaten to expose intimate photos or videos in an attempt to obtain power and control over a victim.
The Prevention of Domestic Violence Act recognizes cyber harassment, including revenge porn, as a form of domestic violence if the person committing the harassment is a current or former intimate partner, family member, or household member. A victim of revenge porn may seek assistance and protection by way of the following:
- Temporary and Final Restraining Order;
- Criminal prosecution of the perpetrator;
- State funded victim assistance programs for emotional, legal, and financial support.
If you are a victim of revenge porn, it is important to speak with a qualified attorney with experience in this niche area of the law. Katelynn Reilly, Esq. and Zachary Sireci, Esq. have successfully obtained Final Restraining Orders for their clients who are victims of revenge porn and are available for consultations to discuss legal options.
