FPSC Recovers $1,650,000 For An Individual Crushed By A Fallen Tree

Attorneys Christian M. Perrucci and Robert M. Donchez of Florio Perrucci Steinhardt Cappelli Tipton & Taylor obtained a One Million Six Hundred and Fifty Thousand Dollar ($1,650,000.00) Mediation Award against a defendant homeowner after a sycamore tree collapsed on a 62-year old man walking his dog on March 2015. The sycamore tree shattered the Plaintiff’s pelvis and caused massive internal injuries. Unfortunately, the Plaintiff never recovered and the injuries resulted in his death six months later.

An early and thorough investigation performed by the firm revealed that the 42-foot sycamore tree had been rotten and obviously leaning toward the roadway for a significant period prior to the accident. The firm was able to obtain photographs from a neighbor taken several years prior to the accident, which revealed a significant lean. Had the case gone to trial, Plaintiffs were confident they could have proven that the defendant homeowner had actual notice of the dangerous nature of the sycamore tree and would have presented evidence that the homeowner was warned about the sycamore tree prior to the accident. Plaintiffs were further confident the jury would have appreciated the tremendous pain and suffering sustained by the Plaintiff during the six-month period prior to his untimely death.

The settlement achieved justice on behalf of the decedent who was survived by his wife and three children. The case remains pending against other defendants including the power utility in the Northampton County Court of Common Pleas.
