Nicholas Sullivan was published in the April 2022 edition of Utility & Transportation Contractor. This is the official publication of the Utility and Transportation Contractors Association of New Jersey. The title of Nick’s article is Retention of Design-Build Plans: The Answer is in the Agreement.

The article discusses a recent lawsuit where there was a dispute about who was the rightful owner of the design plans for a public project that was not completed. In this case, the New Jersey Appellate Division decided that the public entity, not the contractor, is the rightful owner of the plans. The basis for the Appellate Division’s opinion was that the Development Agreement between the parties made it clear that the plans belonged to the public entity when the contract was terminated. This case highlights the importance of understanding the terms of the Development Agreement. Contractors should consider and understand their ownership rights of plans, surveys, data, reports, and so forth when entering into such an agreement.
